Terms of Use

1. Acceptance of Terms

By accessing or using Vocua ("the Service"), you agree to be bound by these Terms of Use. If you do not agree, you may not use the Service. The Service is operated by Mago Negrón, Vienna, Austria ("we", "us", "our").

2. Description of Service

Vocua is a web and mobile flashcard and spaced repetition learning application. The Service allows you to create note types, notes, and decks of flashcards, study them using spaced repetition algorithms, and optionally use AI-powered features to assist with card creation. The mobile app supports offline study capabilities.

3. Subscription and Pricing

Vocua offers a free tier and a paid Pro tier. The free tier includes unlimited flashcard creation, study sessions, and core features with a 100MB storage limit. The Pro tier unlocks additional storage (5GB), server-side AI features, and is available via monthly or annual subscription. Subscriptions are managed through our payment provider, Polar. You may cancel your subscription at any time; your data is preserved but paid features revert to free tier limits.

4. Account Registration

To use the Service, you must create an account by providing a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 16 years of age to create an account.

5. User Content

You retain ownership of all content you create within the Service, including note types, notes, and uploaded files. You grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you. We do not claim any ownership rights over your content. You may export all your content at any time as a JSON file from the Settings page.

6. Bring Your Own Key (BYOK)

The Service offers optional AI features powered by third-party providers (e.g., Google Gemini, OpenAI). When you use the BYOK feature, you provide your own API key and agree to the terms of service of the respective AI provider. Your API keys are stored with AES-256-GCM encryption and are never exposed in API responses. Free tier users can use BYOK to access AI features with their own API key. Pro tier users additionally receive server-side AI access without needing their own key. We are not responsible for charges incurred with your AI provider or for the content generated by third-party AI services.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload content that infringes on intellectual property rights of others
• Attempt to gain unauthorized access to the Service or its systems
• Use automated tools to scrape, crawl, or otherwise extract data from the Service
• Interfere with or disrupt the Service or its infrastructure

8. Service Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We are not liable for any loss or damage resulting from service interruptions.

9. Intellectual Property

The Service, including its design, code, and branding, is owned by us and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.

10. Termination

You may delete your account at any time through the Settings page. Upon deletion, all your data — including note types, notes, decks, study progress, uploaded files (images, audio), and API keys — is permanently and irrecoverably deleted from our database and file storage. We reserve the right to ban, suspend, or terminate accounts that violate these Terms.

11. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim.

12. Governing Law

These Terms are governed by the laws of the Republic of Austria. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Vienna, Austria. If you are a consumer within the EU, you may also bring proceedings in the courts of your country of residence.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
